CLARIFICATION OF QUERIES

Dear Members,
There has been number of queries from the Members of the Society during last few days regarding various issues and they desire that those queries be suitably answered. Therefore, all the issues are being taken up so that the members become clear in their mind. The members have shown overwhelming response and shown their eagerness to become member of the Society,which prompted us to get “Neelkanth Mahadev Welfare Society” registered under the Societies Registration Act-1860 so that after purchasing the land from the market, the Society may participate in the Land Pooling Policy under MPD 2021.

1. The Members wish to know as to whether the Society is similar to Societies registered under the Societies Registration Act.

In this regard, we have already clarified that “Neelkanth Mahadev Welfare Society” is a Society registered under the Societies Registration Act, 1860 with the Registrar of Firms and Societies, New Delhi District. It cannot be treated as a Cooperative Society since the Cooperative Society is required to be registered under Delhi Cooperative Societies Act , 2003 in the office of Registrar of Cooperative Societies, Govt. of NCT of Delhi.

The Aims and Objective and bye-laws of our Society are duly registered which permit us to acquire land and take up the housing project so as to provide low cost housing for its members and as a welfare activity. The society is working for the welfare of its members. It must also be taken in to notice that it is the objective of a Society which maters not the name or the title.

2. Members have also desired to know the operational philosophy of the society.

In this regard it is clarified that this being a welfare society, shall function on the basis of “No Profit No Loss” and shall run in the interest and welfare of its members. On behalf of “The Managing Committee” we wish to assure every member that full transparency in the working of the Society shall be maintained.

3. What will be the expected location of land to be acquired by the Society?

It is also the question being frequently asked. Please recall that in our earlier correspondence we have confirmed that on the demand of all members of the society, it was decided to acquire land in village UJWA zone which is extension of Dwarka.

4. What type of society is Neelkanth Mahadev Welfare Society?

Our society is registered under the provisions of Indian Society Registration Act, 1860 (As applicable on to NCT of Delhi) in NCT of Delhi as a not for profit organization.

6. Who can become member of Neelkanth Mahadev Welfare Society?

Society membership is open for any serving and/or retired employees of Engineers India Ltd and their spouses or their friends, relatives etc. All eligible person has to make an application for the membership of the society to the Management Committee with annual membership fee and subscription fee. After obtaining the membership of society, members can become member of Society’s Land Pooling Scheme by making payment on account of land acquisition contribution and other contribution.

Further membership of the Society is open to any person who has attained the age of 18 years and fulfills the terms and conditions of the Society but subject to the written approval of the Management Committee of the Society. If the membership is not approved by the Management Committee of the Society, the reason of refusal shall be communicated in writing to the person / applicant concerned.

7. Which group/class majority of members of society represent/appear?

Majority of Society Members are serving/retired employees of Engineers India Ltd or their spouses, friends, relatives and other close associates.

8. What are the aims and objectives of the society?

Society’s aims and objectives in brief is to undertake Social Welfare Schemes at “No Profit No Loss Basis”, for the Employees of Engineers India Ltd, serving and/or retired, for spouses of the serving/retired/deceased Engineers India Ltd Employees, or their friends, relatives, and other associates, by inter alia promoting the housing schemes and construction of houses and providing all possible help and required inputs for housing to achieve this object; and to do all such lawful things as are incidental or conductive to the attainment of the above objects or any of them and also to act as an Association of Apartment Owners of the Society known as “Neelkanth Mahadev Welfare Society”, who have filed their declarations submitting their respective Apartments to the provisions of the Act, in such a manner as to protect the legitimate rights, privileges and interest of all its Members, with prejudice, or favour to none.

9. What are the plans of Neelkanth Mahadev Welfare Society for housing for its Members?

Society has acquired land under the DDA’s Land Pooling Policy and it look forward to construct apartment/flats on the concept of Group Housing, Row Housing, Flats, Multi-Storeyed Flats and Single Units on no profit no loss basis. The flats shall be constructed under the Land Pooling Scheme of DDA along with Land Pooling Members and who shall bear the cost of land acquisition and construction any govt. charges, taxes, and any other associated cost.

10. What is Land Pooling Policy of DDA?

Land Pooling is a concept that where small chunks of land are owned by group of owners who assemble for the development of infrastructure as per the provisions of the Delhi Development Act 1957. The Central Govt. has recently notified Land Pooling Policy, 2018.

11. How much land society has purchased and where?

Society has purchased 16 Acres of land and same is situated Village – Ujwa, Nazafgarh, Delhi

12. When did society got registered and where?

Society was registered in the year 2013 in NCT of Delhi under the jurisdiction of SDM, New Delhi.

13. What is the admission process?

Any person willing to acquire membership of society should make application to the Management Committee along with annual membership fee and subscription fee.

14. What is the resignation/refund policy?

Any member may resign and seek refund (interest free) of land acquisition contribution anytime. However, refund will be processed only upon availability of funds with the society. Alternatively, an outgoing member may bring some new member into the society and in that case, society shall be able to process refunds immediately out of funds brought into the society by incoming member referred by outgoing member.

15. What is possibility of transfer of membership within blood relation?

Yes, any member can transfer his membership with blood relation and to any other person.

16. Can a member upgrade/downgrade his category of membership and how?

Yes. Subject to the availability in the respective category, Management Committee may consider the request, when an application has been made in this regard. Downgrading applications will only be approved, if society shall have sufficient funds for processing the refund.

17. How construction cost will be demanded?

A demand on account of construction cost shall be raised by the Management Committee upon completion of phase vise construction. Society will offer construction linked payment plan.

18. How draw of flats will be done?

Allotment of flats will be made on the basis of lottery system.

19. How can membership be renamed?

Membership can only be renamed upon transfer/inheritance.

20. What is the process for nomination and change in nomination?

A Member may by writing under his hand, in the prescribed form, nominate a person or persons, to whom the whole or part of the interest of the Member in the Flat in the Society shall be transferred in the event of his death. The acknowledgment of the nomination by the society, shall be deemed to be the acceptance of nomination by the General Secretary. A Member may revoke or revise his/her nomination, at any time, by making an application, in writing, under his hand, to the General Secretary of the Society. The acknowledgement of the variation in nomination / subsequent nomination by the Secretary, shall be deemed to be the cancellation of earlier nomination.

On receipt of the nomination form, or the letter for revocation of the earlier nomination, the same shall be taken on record by the President/General Secretary. Every such nomination or revocation thereof shall be entered in the register of nominations by the President/General Secretary of the Society.

21. How to login in society website?

23. How can I pay my annual membership fee to society?

Members can write Cheque in the name of ‘Neelkanth Mahadev Welfare Society’ or also pay online via NEFT/IMPS/RTGS directly into Society’s Account. Society’s Bank Account details are provided below. In case of online payment, members are advised to send copy of transaction confirmation and their full name and membership number to society’s email at nmw.society@gmail.com
